Most NNN agreements sold online are English templates. Two problems: your supplier will not sign a document he cannot read, and a Chinese court will not enforce one that is not in Chinese.

What is an NNN agreement, and how is it different from an NDA?
An NDA only covers secrecy. NNN adds non-use (they cannot make your product for anyone else) and non-circumvention (they cannot go around you to your customers). For China sourcing, NNN is the standard tool, because an NDA alone does not stop a factory from copying your product.
Will a Chinese supplier actually sign this?
Often not, if it is a one-sided English document. I draft in Chinese as well and keep the obligations specific and bounded, which measurably raises the signing rate. You also get a short Chinese note explaining the agreement to the supplier.
Which version should the supplier sign - English or Chinese?
The Chinese one. If the agreement is silent on language, a Chinese court works from the Chinese text. I make the Chinese version the governing one, and give you the English version for your own review.
Is an NNN agreement enforceable in China?
Yes, if it is drafted for the Chinese system: Chinese text, Chinese governing law, a forum that can act, and a penalty set at a level a court will uphold. A penalty far above your actual loss is likely to be reduced on request.
How large should the penalty clause be?
Big enough to deter, small enough to survive. Under PRC judicial practice, a penalty more than 30% above actual loss is generally treated as excessive and can be reduced. I set it against a defensible calculation of your loss, not a round number.
